Qualifications

Brian Samuel Malkin has worked as a civil litigator, handling countless cases from initial pleadings, discovery, motions practice, trial and appeal. He has appeared before trial judges and juries, administrative boards, arbitrators and mediators. His peers in the Alleghneny County Bar Association have rated him “Recommended” for the position of trial court judge having found that he possess the reputation for the utmost integrity and the legal ability, experience and temperament to excel as a trial court judge in the Allegheny County Court of Common Pleas.

Trial Attorney

During his over 24 years as a lawyer, Mr. Malkin has represented individuals, small businesses, large businesses, municipalities, municipal authorities, and all in trial courts all over various counties in Pennsylvania. No matter how small or large the case, he did everything he could to ensure that his clients got a full and fair hearing when they appeared before the court. He started his career working as an attorney decision writer for the Pennsylvania Workers’ Compensation Bureau. He then represented injured workers and individuals in private practice. He then practiced for 13 years in a litigation law firm where he was a partner for 6 of those years.  During his last 9 years, he has worked as a Senior Attorney and then Principle Attorney for Ference & Associates LLC, representing parties in business, trademark, copyright, and patent cases in and out of court. 

His experience in the law is diverse, having handled car accident cases, property damage cases, medical malpractice cases, business disputes, employment claims, and federal trademark and patent infringement cases, to name a few. All of these areas of knowledge have contributed to his abilities to help his clients. Having been in so many courtrooms, he has seen and heard what works and what does not work in a courtroom.  He has learned what good judges do to contribute to the fair and efficient administration of justice. He will apply all of his experiences and all of his knowledge to succeed at his judicial duties if elected.

As a lawyer, Brian Samuel Malkin has provided pro bono representation for countless hours to less fortunate individuals who needed legal representation in matters from landlord/tenant cases employment, unemployment, workers’ compensation, and social security disability.

For the last 10 years of his career, Mr. Malkin has worked for various local government boards, Most recently, Mr. Malkin worked on the Franklin Park Borough Zoning and Hearing Appeals Board as the Chair. There, he heard many unrepresented parties present their cases. With his colleagues on the Board, he has ensured that these parties were heard and were made aware of their legal rights.
